1. About WithYou
WithYou is a personal safety mobile application that lets you share your location and journey status with people you trust during specific journeys. You can also escalate to “Suspicious” or “Emergency” states to signal distress to your trusted contacts.
WithYou is designed for individuals and families, including parents who want to help children stay safe on journeys such as walking home from school. Users under 13 may use the app with verifiable parental consent.
WithYou is currently in beta, distributed via Apple TestFlight to invited testers. By accepting your TestFlight invitation and using the app, you agree to these Terms. As a beta tester, you understand that features may change, service may be interrupted, and data may occasionally be reset between builds. Your feedback helps us improve the app before public launch.
These Terms of Service form a legally binding agreement between you and Slumbr LTD.
2. Important: WithYou is not an emergency service
WithYou is not a substitute for emergency services. In a genuine emergency, call 999 (UK) or your local emergency number immediately.
WithYou is a tool to help you stay in touch with people you trust. It is not monitored by emergency responders, paramedics, police, or any other authority. We do not dispatch help on your behalf. Your trusted contacts may or may not respond in time, and we have no control over whether they do.
You acknowledge that:
- We do not guarantee that your trusted contacts will see, respond to, or act on alerts sent through WithYou
- We do not guarantee the app will function in every network condition, on every device, or at every moment
- Location accuracy depends on your device’s GPS and operating system, which we do not control
- Push notifications depend on Apple’s infrastructure, your device’s settings, and battery state
- As a beta product, WithYou may contain bugs, may behave unpredictably, and should not be relied on as your sole safety mechanism
- You remain responsible for your own safety at all times
3. Account and eligibility
To use WithYou you must:
- Be at least 13 years old, OR have your parent or guardian’s verifiable consent if you are under 13 (see the Privacy Policy, Section 9, for how parental consent works during the beta)
- Have accepted a valid TestFlight invitation to the beta
- Provide a valid phone number that you have the right to use
- Provide accurate information when creating your account
For accounts used by children under 13. A parent or guardian who has consented to a child’s use of WithYou is responsible for:
- Ensuring the child understands the safety disclaimers in Section 2 in age-appropriate terms
- Supervising the child’s use of the app
- The child’s compliance with these Terms
- Confirming that any trusted contacts the child adds are appropriate and have consented to that role
You are responsible for keeping your account credentials and emergency PIN secure. Do not share them.
4. Trusted contacts
When you add someone as a trusted contact:
- You must have their consent. Adding someone without their consent may breach their privacy rights and violate these Terms.
- You are responsible for ensuring they understand the role and how to respond if they do not have the app installed.
- A trusted contact has the same right to remove themselves from your contact list as you have to remove them.
You must not use WithYou to surveil, track, or harass anyone. Adding a person as a trusted contact creates a consent-based reciprocal relationship, not a one-way tracking arrangement. The exception is the parent-child relationship governed by Section 3, where the parent’s supervisory role is recognised by these Terms and applicable law.
5. Acceptable use
You agree not to:
- Use WithYou to harass, threaten, stalk, or harm any person
- Trigger false emergencies or otherwise misuse the alert system
- Add contacts who have not consented to being added
- Impersonate another person or create accounts using someone else’s phone number
- Attempt to reverse-engineer, decompile, or interfere with the security of the app
- Use WithYou for any illegal purpose or in violation of any law applicable to you
- Distribute the TestFlight beta build to people outside our approved tester list
We may suspend or terminate accounts for violations.
6. Privacy
Your use of WithYou is also governed by our Privacy Policy, which explains what data we collect and how we use it. By agreeing to these Terms, you also acknowledge the Privacy Policy.
7. Intellectual property
WithYou, its content, and its branding are owned by Slumbr LTD. You receive a limited, non-exclusive, non-transferable licence to use the beta app for personal, non-commercial testing purposes in accordance with these Terms. You do not receive any other rights.
You retain ownership of any data you provide to WithYou (your account info, journey data, contact list). You grant us a limited licence to process that data as described in the Privacy Policy, solely to provide the service.
8. Termination
You may delete your account at any time through Settings. Account deletion is permanent and removes all your data per the Privacy Policy.
A parent or guardian may at any time withdraw consent for a child’s account by emailing contact@slumbr.ai. This will result in the child’s account being deleted.
We may suspend or terminate your account, or remove you from the beta, if you breach these Terms, abuse the service, or for any other reason we reasonably believe is necessary to protect users or the service. We will notify you of termination by email where reasonably possible.
The beta itself may end at any time. When it does, we will provide reasonable notice and either roll you onto the public version of WithYou or delete your account data per the Privacy Policy.
9. Limitation of liability
To the maximum extent permitted by law:
- WithYou is provided “as is” without warranties of any kind, express or implied
- The beta version is explicitly understood by you to be incomplete software offered for testing; we provide no service-level commitments
- We do not warrant that the service will be uninterrupted, error-free, or available at any specific time
- We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of WithYou or any failure of the service
- We are not liable for the acts or omissions of your trusted contacts, emergency services, or any third party
- Our total aggregate liability to you in connection with WithYou is limited to £100
Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded under English law.
10. Indemnity
You agree to indemnify Slumbr LTD against any claims, damages, or expenses arising from your misuse of WithYou, your breach of these Terms, or your violation of any law or third party’s rights through your use of the service.
If you are the parent or guardian of a child under 13 who uses WithYou with your consent, this indemnity extends to claims arising from the child’s use of the app under your supervision, except where the claim arises from our negligence.
11. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. For material changes, we will notify you in-app and/or by email before the changes take effect. Continued use after the effective date constitutes acceptance.
12. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer law gives you the right to bring a claim in your local courts.
